Terms of Use

Overview
These Terms of Use govern your use of and access to Outfifth’s products and services, including the Outfifth desktop application, Outfifth Editions, school access versions, and any related websites, materials, or future services. By using Outfifth’s services, you agree to these Terms. If you do not agree, you should not use any of Outfifth’s services.
Purpose
Outfifth provides real-time, step-based guidance that helps users learn and navigate creative and other software through an on-screen interface using computer vision. Outfifth exists to support hands-on skill development, including use within schools and institutions, while maintaining a broader cultural mission expressed through Outfifth Editions. The services are designed to enhance user capability, not automate creative work, and to offer an educational framework that strengthens creativity.
Eligibility and Access
Outfifth is available to users of legal age in their jurisdiction. Minors may access Outfifth solely when they are associated with partner institutions that have authorized their use of the services; institutional awareness and consent are sufficient for such access.
Users must create their own accounts, including students signing up under institution-provided access. Each user is responsible for all activity that occurs under their account, and partner institutions are responsible for ensuring appropriate student use within their programs. A single subscription may be accessed on multiple devices, provided it is tied to one user account.
Accounts and Subscriptions
Outfifth uses Stripe, Inc. and its affiliates as third-party service providers for payment processing services. By using the services, you agree to be bound by Stripe’s terms and other regulations.
Outfifth offers multiple subscription tiers with both monthly and yearly billing options. Charges apply immediately upon subscription activation, and all payments are final. If a payment fails or a billing authorization is declined, access to the Services is suspended immediately until payment is resolved.
Users may create an account using either their email address or a supported single sign-on method such as Google. Users must maintain accurate information and are responsible for all activity conducted through their accounts. Account sharing is not permitted.
Institutional access is available through defined seat-based subscriptions purchased by partner schools. These institutional subscriptions run for the duration of an academic session and expire automatically at term end unless renewed. Individual students create and manage their own accounts to activate school-provided access.
Users may cancel their subscriptions at any time, which stops future renewals but does not result in any refunds or credits.
Use of the Services
Outfifth provides real-time, on-screen guidance intended solely for learning and skill development within creative software. The services are not designed to automate tasks, generate creative work, or execute actions on behalf of the user.
Outfifth uses computer vision to observe screen activity for the purpose of delivering guidance. This process does not store or record what is seen on the user’s device. Outfifth may not be compatible with all versions of third-party creative software, and compatibility may change as those applications evolve.
Outfifth cannot function offline. Internet access is required at all times.
Users must ensure they are operating lawful copies of any third-party software used with Outfifth, that they follow all instructions responsibly, and that their device meets any stated minimum requirements. Outfifth makes no guarantee regarding learning outcomes, accuracy, or improvement, and is not responsible for project results, file damage, software crashes, or any issues arising from user actions or system configurations.
User Conduct
Users agree to use Outfifth in compliance with all applicable local laws. Users must not engage in any activity that could reasonably put Outfifth, its affiliates, or other users at risk. This includes, but is not limited to, activities that may harm the platform, its systems, or other users. Outfifth reserves the right to suspend user accounts immediately for any violation of these terms.
Intellectual Property
All content available on Outfifth including Outfifth Editions is the sole property of Outfifth. Users are granted a limited, non-exclusive, non-transferable license to access and use the content for personal or educational purposes only. Users may not reproduce, distribute, modify, or exploit Outfifth content for commercial purposes without explicit written permission.
Limitations of Liability and Disclaimers
Outfifth provides its services on an “as is” and “as available” basis without warranties of any kind, express or implied. Outfifth does not guarantee learning outcomes, accuracy, performance, improvement, or compatibility with any specific device, operating system, or third-party creative software.
Users rely on all instructions, guidance, and outputs at their own risk. Outfifth is not responsible for any issues arising from the use of third-party creative tools, including but not limited to software errors, malfunctions, interface changes, compatibility problems, or unintended results.
To the maximum extent permitted by law, Outfifth is not liable for any loss or damage of any kind, including indirect, incidental, special, consequential, exemplary, or punitive damages; loss of data; corruption of files; device damage; or loss of revenue, profits, or opportunities. Outfifth is not responsible for outages, interruptions, delays, maintenance periods, or the unavailability of any services.
You agree that your sole remedy for dissatisfaction with the services is to discontinue use.
Privacy
Outfifth respects your privacy. The collection, use, and protection of personal information are governed by our Privacy Policy, which can be read here. By using Outfifth, you agree to the practices described in the Privacy Policy.
Modifications
Outfifth reserves the right to modify, update, or revise these Terms of Use, subscription plans, and any services or features at any time. Continued use of Outfifth following any modifications constitutes acceptance of the updated Terms. You are encouraged to review the Terms regularly to stay informed of any changes.
Governing Law
These Terms of Use will be governed by and interpreted in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein, without giving effect to any principles of conflicts of law.
